Only 3 subjects can appeal the Court on the unconstitutionality of Article 34 of the European Convention - Rustavi2 Case

"There is only one possibility, that Article 34 of the Convention, which is used by the European Court of Human Rights, can be challenged in the Constitutional Court ," - the Constitutional Litigation lawyer of the Young Lawyers Association, Giorgi Gotsiridze, Rustavi2 case on appeal, explained the possibilities to appeal the Rustavi2 after the Strasbourg court decision.

Lawyers of Kibar Khalvashi are now considering possibilities of obtaining control over the broadcastng company.

However, Giorgi Gotsiridze stated that Kibar Khalvashi can not address the Constitutional Court with an appeal himself.

"According to the International agreement , the Constitutional Court on the issues of constitutionality can be appealed by only 3 subjects, the government, the President and 1/5 of the Members of Parliament . However, recognizing this article unconstitutional is another matter, because recognizing Article 34 as unconstitutional opposes the goals of the European Convention, "- said Giorgi Gotsiridze.
