The Strasbourg Court declared the complaints filed by the population living in the Tskhinvali region against Georgia inadmissible. Such a statement made today the Minister of Justice.
“In connection with the August 2008 war, Georgia won another victory in the Strasbourg Court. The European Court of Human Rights declared 370 individual complaints, filed by the population of the Tskhinvali region against Georgia under the coordination of Russia, inadmissible. The Strasbourg Court shared the Georgian side’s arguments that the Tskhinvali region was actively bombed by Russia during the war and that the Georgian Armed Forces did not exercise control over the Tskhinvali region and the surrounding area. Therefore, it is impossible to attribute any violation to Georgia. Besides, the European Court shared the Georgian side’s arguments that the complaints were ill-founded and did not even meet the minimum standard to substantiate the applicants’ claims.
Following this decision, the Strasbourg Court will consider only 154 complaints against Georgia, which is the best indicator since Georgia became a member of the Council of Europe. For example, in 2009 - 2012, the European Court considered between 3,000 and 4,000 complaints against Georgia.
The sharp decline in complaints is a result of the reforms implemented by the Georgian Government in recent years, after which Georgian citizens have been able to effectively protect their rights inside the country”, - said Rati Bregadze.
