Amendment to the Criminal Procedural Code was adopted by the Parliament in the first reading

The amendment to the Criminal Procedural Code provides for the separation of investigative and prosecutorial functions, which was adopted by the Parliament in the first reading with 87 votes.

The recent changes to the Code grant the investigator the authority to make the decision to initiate an investigation. However, they are obligated to inform the prosecutor about it within 12 hours through any means.

Additionally, the prosecutor now has the power to examine the legality of the decision to refuse to initiate an investigation and instruct the investigator to begin investigating a particular case. The prosecutor can also provide instructions to the head of the investigative department to commence an investigation if a complaint about the refusal to initiate an investigation is approved.

The draft of amendments to the Criminal Procedure Code is a constituent part of one of the points of the European Union’s recommendations.
