SIS arrested a law enforcement officer on the fact of ill-treatment based on the decision of the ECHR

Based on the re-investigation conducted by the Special Investigation Service and the decision of the European Court of Human Rights, inspector-investigator of the Sighnaghi Unit of the Kakheti Police Department of the Ministry of Internal Affairs, G.N. was arrested for the fact of ill-treatment of citizen Vladimir Mchedlishvili in the police administrative building.

The investigation established that on May 15, 2017, the victim Vladimer Mchedlishvili was drinking alcohol with his companions in the area of the Sighnaghi City Wedding Hall. At that time, the employees of the Sighnaghi Police Unit came to him. One of the policemen - G. N. urged him to stop drinking alcohol in public, which resulted in a dispute between them. Police officers arrested Mchedlishvili administratively and took him to the administrative building of the Sighnaghi Police Unit, where inspector-investigator G. N. hit the detainee with his fists and legs on the sides and head, and abused him verbally for several minutes. As a result of the violence, the detainee was diagnosed with broken ribs and multiple other injuries.

The case investigation was launched in 2017, at the same time the victim applied to the European Court of Human Rights in Strasbourg to protect his rights, which published the decision on the case on December 14, 2023, and found a violation of Article 3 of the European Convention on Human Rights – ECHR (prohibition of torture/inhuman treatment) against the victim Mchedlishvili. After this decision, Georgia was obliged to conduct a re-investigation.

The Special Investigation Service handed over the case in 2024 and ensured a re-investigation. As part of the renewed investigation, together with the already obtained evidence, the service ensured the establishment of new circumstances. Forensic and habitoscopic examinations were conducted, eyewitnesses were found, and relevant documents were seized.

As a result of the re-investigation and obtained evidence, based on the court ruling, the Special Investigation Service arrested G.N. former inspector-investigator of the Ministry of Internal Affairs for violently exceeding his official power, who left the Police in 2021.

The crime provided for Article 333 (3b) of the Criminal Code of Georgia is punishable by imprisonment for a term of 5 to 8 years.

We would like to remind the public that based on the legislative changes in 2022, the Special Investigation Service has a mandate to re-investigate the facts of violations of the ECHR established by the legally binding decision of the European Court of Human Rights (ECtHR).

The Special Investigation Service was able to re-investigate the mentioned case and effectively execute the decision of the ECtHR within the granted and increased mandate by the legislation.
