Legal Issues Committee declined the justified comments of the President on the amendment to the Election Code

The Committee discussed and declined the justified comments of the President on the amendment to the Election Code.

As the justified comments reflect, the advisory group of the Central Election Commission, set-up within the term of 10 days upon the announcement of the Elections for the electoral period shall not be dismissed.

At that, the amendment on the so-called “anti-Czech” mechanism shall not be introduced to the Code, which envisages that if the CEC fails to make a decision through voting, which requires at least 2/3 of the full composition of the Commission, the decision may be submitted to the repeated voting at the same sitting. In this case, the hereof decision shall be considered made if approved by the full composition of the CEC.

The justified comments of the President share the only paragraph of the amendments introduced on May 30, stipulating that the activity and/or the remuneration of the temporary member of the District Election Commission (DEC), the auxiliary or technical employee of the DEC, and the member of the Precinct Election Commission (PEC) shall not, in his/her prejudice, affect the registration of his/her family members in the socially vulnerable database, the issue of the social allowance and/or state allowance thereto, the application of the social benefits and/or participation in the state employment program/subprogram.

After the Committee declined the justified comments, the Committee members voted and approved the initial edition of the Draft.
